The following Terms and Conditions do not affect your statutory rights as a consumer.
Please read the following carefully and in full.

Business Trading Details and Customer Relations

All products and services offered within this website are owned by the Fresh Cube Ltd. The organisation is internet based and ALL tangible goods are delivered via post. Digitally-Fresh's registered place of business is as follow:

All written communications should be sent to the above address. Please note that we can only sell our products via email and do not have the facility to sell goods from the above address.

All customer service related emails should be addressed to info@digitally-fresh.com.  Digitally-Fresh aims to respond to all emails within two working days. All complaints should be directed to info@digitally-fresh.com.  

Please be aware of the following terms used below refer to:

WE / US / THE BUSINESS - Fresh Cube and / or Fresh Cube Ltd and / or and / or Digitally-Fresh and / or http://www.digitally-fresh.com

YOU / THE CUSTOMER - The named or intended person who has purchased / wishes to purchase any product(s) or service(s) from Fresh Cube.

PRODUCTS - All tangible goods.

SERVICES - All intangible goods. Wireless networking, VoIP services, web design and advertising.

PROCESS - The required product being sent out via post by SKYPEstyle.co.uk and the recipient being in receipt of the good. This does not apply to pre-ordering or special orders.
 

Terms and Conditions of Sale For Products

The Terms and Conditions set out below apply to all transactions carried out by Fresh Cube via http://www.digitally-fresh.com. Please ensure that you have read these carefully before placing an order. By placing an order through Fresh Cube Ltd you are accepting our Terms and Conditions in an implied way. Digitally-Fresh reserve the right to alter the Terms and Conditions stated below at anytime and with no prior notice to the customer.

Purchase and Delivery

All customers must be at least 18 years or older.
All products will be sold for the amount stated on http://www.digitally-fresh.com at the time of purchase and is the final price excluding Postage and Packaging costs.

Digitally-Fresh aims to process all orders within 5 working days after an order has been placed. However, in the unlikely event of a delay, we reserve the right to allow up to 15 working days to deliver a product. If you have not received your goods within 28 working days of expected delivery, we will provide an opportunity for the customer to cancel their contract with us and provide a full refund within 3 working days of the contract being cancelled.

Goods are subject to availability. Processing only begins from the time Digitally-Fresh has the required product in stock. As mentioned above, if we are unable to supply the product(s) within 28 working days, we will notify you by e-mail (if this is not possible, communication will be sent via post) on the 28th working day. A full refund will be given where applicable.

Postage and Packaging Costs

Postage and Packaging costs are as follow:

UK Standard Delivery - £4.99
UK Next Day Delivery - £6.99 
European Delivery - £14.99
Rest Of World - £29.99


Delivery Times

All orders placed within the United Kingdom are sent via Royal Mail Registered Delivery. All orders outside of the UK are sent by First Class Post. Most orders are received within one working day of the product being sent, however, please allow up to 5 working days to receive your product. All products sent via post are insured up to and including the value of £28 only. Products are only considered "lost" if they have not been received within 14 days of despatch.

If the customer wishes for any product(s) to be sent via any other method then this can be arranged, however Postage and Packaging costs will then vary and a one-off payment will need to be made from the customer to Fresh Cube via PayPal.

Credit Card Fraud and use of PayPal

Please care when filling out the details on the payment pages, particularly your card details. Your order may be accepted and then cancelled down if there are inconsistencies between the card details you enter, and those held by the bank. We are happy to deliver to your place of work on your first order with us, but if your credit card details don't match it will get flagged up by our fraud detection systems.

It is the customers responsibility to ensure they make a secure payment to Fresh Cube via PayPal. Fresh Cube will not be held liable for the misuse or unauthorised use of any form of payment via PayPal. By purchasing from i-magine you are accepting that you, the customer, is solely responsible for any misuse or losses incurred when purchasing products from us via the internet  and i-magine is absolved of all liability.

Price

The price you pay is the price displayed on http://www.digitally-fresh.com at the time we receive your order, plus the cost of Shipping and Handling. We may sell the same item at a higher or lower price elsewhere. In the unlikely event of an order being wrong and the price displayed on our website differing from that which is being charged via PayPal, Fresh Cube reserve the right to chose which price the product is being sold for.

Payment

Payment is accepted by either Credit Card, PayPal or cheque. We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you. If we have reason to suspect that your details have been obtained fraudulently from us, we will report this to you and the relevant authority.

In the event of receiving payment by cheque, the product will only be posted to the customer once the cheque has cleared and the funds are secure in Fresh Cube's bank account.

Pre-orders

Please be aware, when orders are placed which contain pre-ordered products the order will be shipped in its entirety when the pre-order item comes into stock. Payment for the order will be taken upon ordering and not upon shipping. If you wish your order to be part-shipped please contact us or specify this when you order.

Returns and Refunds

Under the Distance Selling Regulations (2000) you have 7 days in which to notify us that you wish to cancel, and the 7 days commences the day after receipt of the goods. A full refund will only be given if the product is unused. Please notify us of your cancellation via email. You are responsible for returning the goods to us via Registered Delivery all cost which are incurred whilst doing this are the customers responsibility. The goods must be returned undamaged. Goods which cannot be resold as new will be rejected for refund and returned to you. If you do not request a refund within 7 days of receiving your product it is at Fresh Cube's discretion to offer you one. If the goods are returned within 7 days, unopened, a full refund (ex P&P) will be given. After 7 days have passed from the date of delivery, we cannot make refunds for other reasons, such as you decide you don't want it any more.

We reserve the right to charge additional postage costs when resending items to customers.

We reserve our right to charge a restocking fee of 25% of the goods where the goods are not faulty.

If the product specifications from the manufacturer have changed, we will do our best to offer you a substitute product of the same or better quality at the same price. We will also contact you to give you the choice to accept or decline this offer. On the rare occasion that there is an error, we will advise you about it as soon as possible.

Beyond the 28 day period we ask that you refer your problems with the products to the manufacturer, as this is the fastest way of resolving warranty-related queries.

Please note: We can not be held responsible for items that are lost or damaged in transit when being returned to us.
All items should be returned via a Recorded Delivery service. It is the buyers/customers responsibility to ensure that adequate insurance and protection is obtained when returning goods to us. Prior to any item being returned to us, please contact david@freshcube.com to obtain a returns form.

Faulty Goods

Please contact us via email before sending any faulty products to the address below. Once we have agreed that the product you have received is faulty please send it the address below unless otherwise stated. Please include a note within the package with your details and explaining what the fault is.

The goods will be tested and and substituted for new goods. All returns will be processed as quickly as possible. As long as the goods are faulty, within 28 days of delivery Digitally-Fresh.com will replace or refund your order.

Cost of returning the faulty goods is the responsibility of the buyer (the customer) and not the seller (Fresh Cube). Refunding postage costs for the return of faulty items is at the discretion of Fresh Cube.


Law

The contract between us shall be governed by the laws of England and any dispute between us will be resolved exclusively in the courts of England.

Data Protection

The Data Protection Act 1998 applies. You may write to the data controller at our place of business above, in order to query what data is held about you.

Complaints

If we, or the product you receive do not totally satisfy you or your expectations please email us at info@digitally-fresh.com and we will do our utmost to rectify the situation. We will reply to you within 72 hours.
